Last Week, i went to a buffet, the food sucked ass and when i got up for another roll..i found a maggot in the bread. 2 other people were with me saw it, a waiter saw it, and the manager saw it. Later on that night my b.fs cousin thew up...

Supposingly the manager gave us the money back (but my b.f payed with a debit card), he handed my b.f the so called "30.84" back but it was rolled up. Now for some reason my b.f didnt count and he cant find that 30.84..all i saw was some ones..so i dont think he gave us all the money back.

so...should my b.f sue him..and for how much?

You can sue, but you will probablly spend more in legal fees than you will get out of any settlement. If its not part of a franchise, chain, etc. They cant give you what they dont have, the most I would expect would be a small settlement and closing or heavy penalty to the resteraunt... plus, if you take money as compensation, that is a settlement, out of court, and therefor you have no legal means to sue them. It is not the resteraunts fault that your bf did not count it, sure they are shady, dirty, fucks, but thats the law.

I know you wouldnt sue over the money... you cant. But what i was saying is accepting any money as compensation, is a legal settlement. If they really wanted too, they could hold it up in court for a long time because of that, however, since it is a chain, and they have money, filing suit could land you a decent settlement as compensation despite accepting a 'refund' (as compensation, even if it was short) since it is less costly to settle than to fight for the company.

There is no action in tort unless there is damage. Seeing a maggot doesn't equate, automatically, to damage. Throwing up later at night, because you're grossed out equally doesn't equate to damage.

But, you are entitled to receive goods and services of a sufficiently high quality. This would be your only means of civil redress in this matter -- at least on the facts as you expressed them. You are entitled a refund of your money if the restaurant provides you with shitty services or terrible goods. That refund, I assume equals $30.84 (not an amount of money anybody should sue for). Seeing that your boyfriend is an ass, and accepts rolled up money, you are not restricted from being able to say that you didn't receive the $30.84. I'm not saying that you received it; I'm saying you can't prove that you didn't receive it. When you can't prove something, you dont go to court. The same goes for the maggot. No picture equals no evidence equals you all shut the fuck up.

Here is my view:

(1) You cannot sue in tort for the sight of the maggot alone

(2) If you develop some damage because you ate foods with maggots in it, that's another story.

(3) Because your boyfriend didn't have the sense to count money as it was passed over, you dont have any proof that you didn't receive $30.84 from the restaurant.

(4) You should swallow your pride, shut the fuck up, and think of alternative places to eat.
