Man, Woman Accused in Rape of Grandchild
SAN ANGELO, Texas (AP) - A couple have been indicted on aggravated sexual assault charges after authorities alleged the man raped his 13-year-old granddaughter and then her grandmother told the girl she ``got what she deserves.''
Arthur Y. Pena, 58, and Lidia Pena, 54, were indicted June 6. Arthur Pena faces three counts of aggravated sexual assault. Lidia Pena is accused of allowing an assault April 10, according to court documents.
``When the victim exited the bedroom, the (grandmother) laughed at her and told her she got what she deserves,'' Tom Green County Sheriff's Deputy Ron Sanders wrote in criminal complaint documents filed in state district court.
Messages left Monday with the grandfather's court-appointed attorney, Paul S. Parker, and the grandmother's, Galen Moeller, were not immediately returned. Prosecutor Bryan Clayton declined to comment.
Lidia Pena also was indicted on one count each of abandoning or endangering a child with imminent danger of bodily injury, as well as injury to a child with intent to cause bodily harm.
An examination at Shannon Medical Center on April 10 showed signs of chronic physical and sexual abuse, according to court documents.
Child Protective Services spokeswoman Marleigh Meisner said the girl and three siblings - two younger sisters and a younger brother - lived with their grandparents. All four are now together in a foster home, she said.
The children's mother had previously placed the children with the couple, said Meisner, who did not know how long the children had lived with their grandparents.
Arthur Pena was in the Tom Green County Jail on $100,000 bail Monday. Lidia Pena was released after posting $100,000 bond. A separate arrest warrant has been issued since her indictment. She had not been arrested as of Monday.
